1. Introduction

Welcome to Artius Glass’ Terms and Conditions. These Terms & Conditions (“Terms”) govern your use of our website located at https://artiusglass.co.uk (the “Site”) and the purchase of goods from Artius Glass (“we”, “us”, or “our”).

By accessing this Site and purchasing products, you agree to be bound by these Terms. Please read them carefully. If you do not agree with these Terms, you must not use this Site.

3. User Accounts

To place an order or join the Collectors Group, you will be required to create an account.

  • You are responsible for maintaining the confidentiality of your account credentials (username and password).
  • You must provide accurate, complete, and current information.
  • We reserve the right to terminate accounts, remove or edit content, or cancel orders at our sole discretion.

4. Products, Measurements, and Descriptions

We sell glass ornaments and decorative glass items. We take great care to ensure that all details, descriptions, and prices of products appearing on the Site are correct at the time when the relevant information was entered.

  • Measurements & Dimensions: All sizes, weights, capacities, and measurements indicated on our Site are approximate. While we endeavour to be as accurate as possible, manual measurement methods may result in slight discrepancies. You acknowledge that the actual product size may vary marginally from the description provided.
  • Handmade Nature: Many of our items are handmade or vintage/collectible glass. As such, slight variations in finish, texture, colour, and shape are to be expected and are not considered defects.
  • Images: We make every effort to display the colours and details of our products accurately. However, as glass is a medium that reflects light and screen settings vary, we cannot guarantee that your device’s display of any colour will be accurate to the physical item.
  • Condition Reports: For vintage or “rare” items, we will describe the condition as accurately as possible in the product listing. It is your responsibility to read the full description and inspect the photos provided before purchasing.

5. Pricing and Payment

  • Currency: All prices are listed in Great British Pounds (GBP).
  • Payment Processing: We use SumUp to process secure card payments. We do not store your credit/debit card details on our servers. SumUp may offer this, but the details will be held by SumUp, not us.
  • Price Changes: We reserve the right to change prices at any time without notice.

6. The Artius Glass Collectors Group (Membership)

We offer an optional paid membership known as the “Artius Glass Collectors Group.”

  • Membership Fee: This is a yearly fee charged at the time of joining/renewing.
  • Benefits: Members receive exclusive discounts and free P&P (Postage & Packaging) on standard orders.
  • Exceptions to Free P&P: Please note that occasionally, for rare, high-value, or exceptionally heavy/fragile items, a shipping charge will apply regardless of membership status. This will be clearly stated in the specific item’s description before purchase.

7. Shipping and Delivery

  • Carrier: We ship items using Royal Mail 48 Tracked.
  • Processing Time: We aim to dispatch orders within 1-2 working days.
  • Estimated Delivery: Delivery typically takes 3–5 working days.
  • Delays: While we strive to meet these delivery times, delays caused by Royal Mail or other third-party couriers are outside our control. We are not liable for delays once the item has been handed over to the courier.
  • Lost Items: If your item has not arrived after 15 working days, please contact us so we can investigate with Royal Mail.

8. Returns and Cancellations (Consumer Contracts Regulations)

As a UK consumer, you have the right to cancel your order under the Consumer Contracts Regulations 2013.

  • Timeframe: You have 14 days from the day you receive your goods to notify us that you wish to return them.
  • Refunds: Once notified, you must return the goods to us within 14 days. We will issue a full refund of the amount paid (including P&P) within 14 days of receiving the items back.
  • Return Shipping: You are responsible for the cost of returning the item to us and ensuring that the item is returned to us undamaged. The item must be returned in its original condition.

9. Damaged Goods

Given the fragile nature of glass, please inspect your order immediately upon arrival.

  • Reporting Damage: If an item arrives damaged, you must contact us via email at ann22wheeler@btinternet.com or ron22wheeler@btinternet.com within 3 working days of delivery.
  • Evidence: Please provide photographic evidence of the damage (including the packaging) to assist us in processing the claim.
  • We will respond to you with further details.

10. Limitation of Liability

To the fullest extent permitted by law, Artius Glass shall not be liable for any indirect, incidental, or consequential damages arising out of the use of the Site or the products purchased.

  • Nothing in these Terms limits our liability for death or personal injury caused by our negligence or for fraud.

11. Intellectual Property

All content included on this Site, such as text, graphics, logos, images, and software, is the property of Artius Glass and/or its content suppliers and is protected by UK and international copyright laws.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of England and Wales.

If you are a business: You and we agree to submit to the exclusive jurisdiction of the courts of England and Wales.
If you are a consumer: You and we both agree to submit to the non-exclusive jurisdiction of the courts of England and Wales. This means that if you are a resident of Northern Ireland, you may also bring proceedings in Northern Ireland, and if you are a resident of Scotland, you may also bring proceedings in Scotland.
